Guide to Tax Clearance in Malaysia for º£½ÇÂÒÂ×riates

Hi all,

I would like to ask about the situation as below:

I am an expatriate, i've arrived Kuala Lumpur on 14-Aug-2018, and i have to pay a tax as Non-Residence of the year of 2018, my residence status will become Residence after the 1-July-2019, and of course i will get back the Tax that i have paid from Aur-2018 untill June-2019, But i have to wait until i completed 182 days in Malaysia in year 2019 (which is July-2019).

And now another thing happening that i decided to come back to my country on 10-July-2019, my question is: can i still get back my Tax if i come to Tax Office right after I submitted resignation letter (because i have to submit it 2 months before the day i leaving)? LHDN will calculate my tax on the day i come to their office, or the date when i submit the resignation letter, or will by the last day i am in Malaysia?

The last date of employment ie last day you receive salary will be the date used for your tax clearance. But you don't mention any holiday travel in 2018 or 2019 which might affect your residence status.

May i know this is the recommendation or the thing i should mention during explain with Tax officer?

FYI, that my travel in-out of Malaysia in 2019 until now is less than 14 days (with mostly using e-gate), and there is no stamped in my Passport, should i collect my boarding pass before i going to tax offce?

Usually the employer can prepare a list of absences and state which are holiday and business trips. The tax office has a form to fill out about the same so the employers letter makes it easier. Any holiday absence in 2019 needs to be added to 2nx July to find new qualification date as tax resident eg July 2nd +8 days holiday = 10th July is new qualifying date as tax resident for 2019.

There is usually a printed receipt given at the e-gate which you can use to backup your list of absences plus boarding passes. The e-gate swipe is a record of your arrivals in lieu of a passport stamp

You should take a copy of your passport plus your 2018 annual tax return when doing tax clearance. There is a cutoff date when it is a requirement to also do a full return for the current tax year. I think it is required from April departures onwards but you need to check this with LHDN.
