Questions about work, salary and visa

jinhduong

Hi all, I'm a new member on this forum. I had a lot of good experiment here through reading the problems of other people  :D , now I have some questions, wondering,... hopefully, will get the help from you guys.  :)

I'm a software engineer. I come from Vietnam and I got an offer from Malaysia company. My basic salary around 9 850 RM (convert from $) and housing allowance is 500 RM, I also know the tax from this year is 28% and after 6 months it'll become to 24% which if base on my salary. The employer told me so. My role is a senior software developer in the work contract (1 year, fixed term contract).

I have some questions that although searched I still not clear

- My salary is normal salary for the same role in Malaysia?  :/
- What type of my visa? And can I make dependent visa for my relatives?   :(
- How long is the visa period processing?  :(

P/s: I'm looking for the condo in Bangsar south, private room. Does anyone have any room available? Please contact me. :)

Thanks all.

You need to ask your employer which visa they are applying for you. Hopefully its the Professional Pass category I or II which mean you can have your spouse and children on dependent or student visas.

You will pay non-resident tax rate for 2017 but there is a chance to link this tax year with 2018 and thereby only pay resident tax rates. To do this, you must not leave on a holiday (personal travel) for more than  14 days for the rest of 2017. AND again, until you have reached the 182 day mark in 2018, no personal travel absences of more than 14 days. (You can travel for business, medical treatment - but not holidaying outside Malaysia). What will happen is that you will be refunded the difference between non-resident and resident tax rates for 2017 and the first 182 days in 2018.

Not sure if you have understood  the Malaysian tax deduction system. Once you are tax resident you will get a tax-free personal allowance of RM7k (and RM 2k for children). After that deduction on your annual salary, you then start to pay different percentages on bands of income. These start at 0%, then 1%, 5% etc. You will only pay higher percentages on income that falls into the higher bands (not the entire annual salary amount). To find your monthly deduction, divide by 12.

You could  check your salary on Glassdoor. The processing of Stage I (Approval to create post and your candidacy for the position) should only take about 2-3 weeks. A lot depends how efficient the employer is at providing the required paperwork. Sometimes they can slow process down.

Hi,

I need some information regarding switching jobs in KL.
Currently I am working in a company where my ep expires on 11th August 2017. I got an offer from different company so instead of extending my contract here I decided to join new one.
I had balance leave of 9 days so I am using the balance leave and hence my last working day will be 31st July.
My new company has submitted my application and it is under process. Since I have doubts regarding the time frame so I decided to exit on 31st to my home country.
In this scenario,do i need to get release letter from my present organization ?
Also, do i need to cancel/shorten my pass before i exit ?
Looking forward to your reply.

Gravitas

You don't need a "no objection letter" or to shorten your ep if your job/ep is coming to an end naturally. You won't be able to start your new job until a date later than 11 August

Thank you so much for the information. So in my case I can come back with stage 1 letter and vdr after 11th ? Though my present company has agreed to provide a release letter.

Gravitas

You didn't have to leave the country while the Stage I was being approved. But now you have done so, I guess you can either return on a visa with reference from your new company or you could also return to Malaysia before your current visa expires. You would just start work on 12th August (with Stage I confirmed and a copy with you when you enter) and just hand your passport to your new employer to process the Stage II.

Thank you.

In line with my previous query regarding no objection..I was trying to follow up my new employer for the approval so the hr said that he did not request for VDR as when he applied i was still in Malaysia. So my doubt is can I get the VDR now and how ?

Gravitas

You are leaving at the end of your work permit - you don't need a no objection letter. Regarding VDR your choices are: ask new employer to request one, or enter before expiry of current ep, or apply for tourist visa (if you intend to enter after expiry of current ep).

So entering with a tourist visa and converting into work permit is also no issue ?

Hi every one, i will go to work in malaysia from august, until the end of 2017, i will have 5 months there. I heard that taxation in first 6 months are 28%, and will return at the end of year.
So may I ask, at the end of 2017, can i get this with holding tax or i must to wait finish contract of 1 year, or i must to wait at the end of 2018.
BR

jinhduong

Your case like myself also from August, as I have researching before, you have to stay on Malaysia more than 6 months then you can get the taxation, You'll get it as I remembered on April/August 2018.

Gravitas

You don't get your tax back if you work only until end of December 2017 and the 28% non-tax resident status applies.

However, if you stay on in Malaysia and work 182 days in 2018 then both 2017 and 2018 will be paid at the resident rate, which is a graduated system i.e. bands of income attract different percentages of income tax.

The rule only allows max 14 days of personal travel absence in each 2017 and 2018.

But do check if you have to pay tax - the threshold is RM34,001 at single rate.
So if you monthly salary is less than RM 2833.33 you don't have to pay tax.

Hello,
I want to ask about an employment offer I received. The company will go through the normal visa procedures. However, I got confused about the company asking me to apply for a single entry visa once the approval letter arrives.
Isn't the single entry visa designed for social visits or does it double as a "visa with reference"?
Furthermore, I am doing all these issues from my home country and my company asked me for my dependents information at the same time. Can my dependent get their pass alonf with my entry visa issuance? Or will I have to travel to Malaysia and from there continue processing so that they can get their dependent pass?
Thanks...
