Will be divorce by honored?

I was married in Costa Rica 12 years ago. Separated for 10 years. I live in the United States, she lives in Costa Rica. I filed for divorce here in New York and mailed the divorce papers for her to sign in front on a notary in the US Embassy of Costa Rica(I was told this is how she needed to sign). She is refusing to sign because she believes the divorce won't be valid in Costa Rica. Is this true? Will our divorce be valid in the USA and Costa Rica or do we also need to file for divorce in Costa Rica?

@kellyj11, my U.S. divorce and U.S. remarriage have been recognized in Costa Rica. There is no reason that yours shouldn't be, too.


Failing that, if your wife/former wife is willing to cooperate, obtaining a legal divorce here in Costa Rica is a simple matter of appearing before a Notary and taking an oath to the effect that you want to be divorced. It may (may) be the case that your wife can do this on her own without your participation.

For that, you'll have to consult a Costa Rican attorney who knows the fine points of the law. The matter also arises in the event that one party dies and his or her estate is probated.Â
