Belgian citizenship response countdown

Ananun

Hi,

After applying for Belgian citizenship,  I got a receipt saying that my dossier is complete end of November. Then I got the police visit end of January due to my long hospital stay. When I called today, the commune told me that my file has been sent to Brussels end of Fabruary and that I need to wait until end of June.

I thought my 4month period started after the receipt, which would have passed already.  Also, was it okay for the commune to transfer my file 3 months after they told me my dossier is complete?  Is it going to negatively affect my application?

I would appreciate any comments on similar experiences!

Thanks!

You're describing a rather strange situation. If you really received a receipt confirming that your file was complete at the end of November, then the 4-month period should start from that date. This means the deadline for a decision was the end of March.

The fact that you were in the hospital and had a police visit in January is completely normal — sometimes the police visit happens even in the 4th month. These steps are not directly tied to the timeline, and your hospital stay had no effect on it.

I don’t know what exactly happened — maybe the commune forgot to send your file, or there were technical problems — but your rights have clearly been violated.

And here’s the key point: if the deadline has passed and you haven’t received a negative decision, then by law, you are already a Belgian citizen.

So, you should go to your commune today with a written complaint. Say that the legal deadline has passed and, according to the law, silence means a positive decision. Include a copy of your receipt and ask them to register you as a Belgian citizen and complete application for your ID card/Passport immediately.

If you don’t know how to write the letter, you can ask ChatGPT to help you. It's best to send the letter by registered mail or hand it in directly at the commune’s reception desk.

Don’t worry — this won’t negatively affect your citizenship. In fact, it’s already granted — you just need to claim it. The commune is not deciding anything; they are just passing on documents.

Good luck and congratulations!
