RP expiration + new local offer

Guest6893

Hi all,

My husband is currently working with an indian employer in Belgium and his RP is getting expired in end of september. His extension is in process. Files are already submiited to Belgium govt by his employer and waiting for approvals.
In the mean time, he got another offer with local employer who is ready to transfer / raise new permit request but there is a chance that current employers withdraw the extension process after putting resgination.
What are the possibility that he stays here in belgium in this case?

Usually residency is allowed 1-2 months after date of your work authorization (check work authorization date and date on résidence start on id).

Usually if current employer submits file to government , they don't take it back as its lot of process involvement to start with government.
But let's face it.

Even if your employer retract the application , applicant (your husband) can still stay:
- it is allowed to stay UpTo 3 months after work authorization to search for a new job
- applicant can become dependent to his wife for short term

But  if new
employer submits file ASAP for applicant (eg.August end), then there should be no issue. As soon as your employer submits application to government, you can stay legally. (As far as i know)

Good luck
