Hi folks. Question about Work permit with Indefinite term


I never heard about this program. Is it something new?

What residency card can I receive if I apply for it? B, L, or any other?

Hello,


technically you can request the unlimited work permit after 4 years of stay to get the unlimited work permit (you can change employer without a work permit).


You'll request the B card by default if you are not eligible for the L.

About the L, you need to have been working for 5 years without gap + pay social security + """high""" salary

(But you need to request it at the commune for the right to be granted. Typically you'll do it when you'll renew your resident permit to not pay a new card)

@AlexFromBelgium  Yes but corresponding to the website and answers that the authorities gave me - you can apply at any time if you are eligible for the "program".


Actually, my issue is that I have been working in Belgium for 5 years. My residency card A - will expire only in 2024, and in the city hall, I was told that I need to wait for 2 years to get my status updated automatically. Of course, I would like to receive permanent status right now to be able to work anywhere without asking for a work permit and waiting 2-3 months




P.S. Also I never heard that you need to work at least 4 years out of 5 to get it...I thought it should be no less than 5.

Bah... in your case, you've been already 5 years in Belgium, so you should go for the permanent resident card...

As you've been working for 5 years, you should probably go for the L card (if you have a """high""" enough salary), else you fallback to the B one.


Both will grant you unlimited work permit as well as you'll be a permanent resident.

Hello All,


Looking for some information about the permanent residence procedure (card D) in Belgium.

I came to Belgium in June 2017 and was working as an expat for 12 months. Post that I switched to a Belgium company (BE Payroll) and have finished my 5 yrs of continuous residence in BE.

As per the information in this link --> I am eligible to apply for PR.

I contacted the commune (1140 - Evere) however the personnel working there refrains from accepting the PR application. They say that I was working as an expat for 1 year and hence my 5 years of stay is incomplete (as per the new law of 2020)

However, several of my colleagues have received a PR in the 1210 and 1000 commune inspite of working as expat for 4 yrs.

It is almost next to impossible to have a conversation with the people working at the 1140 commune in this regard and I am just waiting without any clear direction.

Hence I write this post and seek advise / opinions in this scenario.

@djv14 They aren't wrong.

Can I ask how you calculated the 5y? Its 5y of paying Belgian social security. So not really 5y of "work" .


There are exemptions to this, such as study period. But an expat contract isn't one of them.


If you started work on Belgian payroll since 2018 (I'm going to assume Jan to be simple), then Jan 2023 you will be eligible for the L card.


ps...D card is now called L card.



PPs...that website is for "unlimited single permit" which is not the same as the L card.


I know this is a clusterf*ck, but yeah, welcome to the mess haha.



For your summary, the following pathways are pathways to unlimited residence (through economic migration):



1) B card.

2) L card.




Anything else, including the single permit unlimited, is NOT an unlimited right of stay.

I have some questions for the indefinite work authorization, can you help if you have an idea?

I have been working in belgium since 2018 , and with a Belgian employer since march 2019.

I reside in Flanders and my employer is situated/registered in Walloon region,

as I read from the website :


I am doing this extension process as my current single permit is due by feb 14, 2023, I will use the work contract from my current employer for this extension.

the competent region for launching the application for indefinite work authorization with any employer is "the domiciled region of the applicant (myself)"


is it a problem, if I use a work contract of the employer for the extension who is in different region ? I assume not!


secondly,

by this request we will have only the approval from employment office ? and for the residence permit I will still apply at the commune after work authorization and then the immigration office will look into it ? How does it work ?
