Child law situation

Lanza77

Has anyone been in a similar situation?!

I am of Irish and British Nationality, with Portuguese residency.  I am married to a Portuguese citizen.

I am currently Ireland but plan to return to Portugal soon with our newborn baby.

My husband and I are currently passing a difficult time in our relationship.

I would like your advice on my rights as a mother to travel back and forth freely from Ireland to Portugal with my baby.

Do I need a letter of permission from my husband to travel?  If I am in Portugal, can my husband refuse permission for me to visit Ireland for short periods? Do I need proof of a return flight? What documents would I need to travel freely with the baby, but without my husband?

Hi Lanza, Welcome.

You should look for advice from a Portuguese consulate in Ireland. Through the SEF website I can help you with this information, which is quite detailed, with forms available there:

My only advice would be for you to consult a family law attorney.
