Wills

Robin & Sue

Hi. Does anyone know if a British will drawn up by a solicitor in England is valid in Romania. We are not married so this is important. Thanks

king the will has legal residence, or it's possible that a will from England is fine but should be in a form accepted by romanian law (handwritten and authenticated by a notary)

If you are a British national and want that English law should govern your succession, your will should include a statement specifying this, otherwise the local romanian law will apply.

In Romania and other civil-law countries, your children or their descendants and the legal spouse, or your parents (if previous categories don't exist) are forced heirs and will inherit a reserved portion of your estate (half of what they may inherit in absence of a will) regardless of what you write in your will.

It is possible to stipulate in a will that a certain asset (a house for example) should be inherited by a certain person, provided its value as a percent from the entire estate value will not diminish the reserved portion inherited by the forced heirs.

These are civil-law notary offices in Arges county. Some are from Campulung and speak English. Call or e-mail them, maybe one will be able to help or give you the correct information.

Thank you. We'll sort this out as soon as he gets out of hospital - he currently has TB & pneumonia but is being excellently treated in the TB hospital in Campulung but hopefully on the road to recovery. As a note to other foreigners in Romania, it's better to sort things like this out before you are in our situation. Hindsight is always good!! Thanks again. Sue
