Resignation during probation period

Please advise me based on the followings:

1. I came in KSA with freelance visa (own visa)

2. I came in KSA for the first time (May 25 2024)

3. Then I got a job in a local company and I transferred sponsorship to that company.

4. Then I have resigned during the probation period. My resignation is approved by all department.

5. My contract clearly states that either party can terminate the contract during probation period, so I terminated the contract at QIWA, now it is showing terminated.

6. I didn’t take any assets from the company, only the desktop which I have returned already.

7. My iqama does expires on 20/11/2024.

8. My current company didn’t increase iqama duration, it is the same time which I made with my freelance visa.


Now my questions are:

1. Can my current company keep me wait for two months without accepting sponsorship transfer at QIWA? Is it legal?

2. Can my current company increase Iqama expiry without my consent even the contract is terminated?

3. What is the legal aspects regarding the issue?

4. Shall I move legally regarding this matter and would it be beneficial for me?

5. Is there anything I can compensate for two months and take release?

5. Is there anything I can compensate for two months and take release?

Answer: Compensation or a release might not be necessary if your contract is already terminated. The priority is finding a new sponsor or transferring your work.


Additional Point:

  • In Saudi Arabia, there is no freelance or own visa. There are only work visas and visit visas. On a work visa, some sponsors may allow you to work for other companies while they receive a share of the benefits.


  • If your contract is terminated, you need to find a new sponsor who allows you to work for other companies, or you must transfer to your current company. Otherwise, your current sponsor may take actions like reporting you as escaped or issuing a final exit.

Regarding answer 1, but still they are delaying my process to finalise the settlement and release.


Regarding answer 2, what should I do now to avoid or stop renewing my iqama if they want to do?


Regarding answer 5, I have already requested to my new company to send sponsorship transfer request at QIWA and they did and I accepted but my current company didn’t response anything so the request is expired.


In QIWA it is showing that the status is terminated and I have already accepted a new request from another company but my current company didn’t do anything, in this case what I should do next?
