What happens if my child, under 2, with Canadian passport, he has PH Mom, and she is also a Canadian passport holder but recently traveled out so my wife is not an issue at the moment. My child does not have dual yet. If he overstays his 1 year stay, what is the penalty? How much? How are you notified about a penalty? Does this occur at immigration when you leave PH?


I guess I could add that I have researched that doing the dual citizen process is much easier at a embassy outside of the Philippines. Does anyone have experience with this?

Hi, my son is a dual citizen. My wife is PH and I am Austrian.


Question 1: Where was your child born. If born in the PH he is Philippine citizen.

Question 2: Is the mother of the child from the PH? If yes, your child is a PH citizen

If I answer 1 with YES and 2 with YES:

You are Canadian and this makes your child a dual citizen. You can get a passport from the DFA for your child with his birth certificate. There is no overstay for a citizen.

If the mother is not a PH citizen anymore and the child was born in Canada, your child is not a PH citizen. In this case your child entered as a tourist and you need to go to the local immigration office and get an exit clearance for the child. You will pay a few thousands Pesos for the violation of the law. The immigration will issue a visa and an exit clearance for your child. With these papers you can leave the Philippines.


If the mother is still a citizen from the PH and the child was born in Canada, you need to apply for a passport for your child to leave the PH. You need to contact the next DFA office for the requirements. Maybe they accept a Canadian Birth Certificate. If not the PH embassy/Consulate in Canada can do it.

Is the mom a Filipino citizen when the baby is born?

If she gave up her citizenship and she has a baby, baby status might change but can always acquire dual citizenship when she applies. She can include the baby in her application esp if the child is under 18.


based on my experience I was a Filipino citizen when I gave birth to my 3 kids in the US. All I did was report their births at the Philippine Embassy. And they got their automatic dual citizenship.


it’s much better to apply in the Philippine embassy located where u live than do it in the Philippines. Philippines is too costly and time consuming. Philippine embassy abroad just take a day but it will take a while to get a copy of the Authenticated Phil birth certificate since they have to send it to the Philippines and back to the country where u reside.

The Mom is Canadian passport holder born in PH and has not applied to get the dual yet. The child, both my children were born in Canada. My wife and oldest child recently travelled out so they are not an issue. My boy didn't go so now trying to decide if we take a quick trip to Hong Kong until we have time to deal with dual. Ideally we would all travel to Canada since it is quicker to file for dual there. I have the PSA birth certificate for both children.
