EU citizen registration certificate and NIF

Yoyagi

Hi there!

I am an EU citizen who will move to Portugal with my family. I will make my NIF and then get my registration certificate. Afterwards I'll set up a family reunion process for my family.

My wife and son need a NIF number also. I am then wondering if I can be the fiscal representative after i get my registration certificate so I can make NIF numbers for my family?

Best regards,

Marius

Hi Marius, hope you are fine since yesterday :)

Good news, It is not required, it is only optional. Check here why:

Portuguese Tax Representation no longer required for non-EU residents:

You can sign up for an electronic notification service from the Tax Authority. It is quite easy.

@JohnnyPT I’m fine 🙂 Hope you’re doing good as well.

So when we go to make NIF numbers for my Non-EU wife and son, we register for this tax notification and do not need to bring a fiscal representative?

Marius

PT Gov website:

In the case of the EU countries and Norway there is tax co-operation, so even this requirement of electronic notifications is not necessary. You don't need to worry about that.

@JohnnyPT if his wife and children are not EU/ Norway citizens they are required a FR until they become residents, which is only when they receive their resident cards after the family reunification appointment which can take longer than a year. The term "non resident" in the law, refers to Porruguese citizens who are not residents.

We do not know yet the nationality of Marius' family members... Norway/any EEE country, or not ...

I am an EU citizen, I am Irish but my husband is English. Once I get my CRUE I intend to apply through SEF under Art 15 which gives the right to spouses to be with their EU partners. It is not family reunification which I think only applies if you are legally resident in Portugal but your family resides elsewhere. I also think Family reunification means a lot more hoops and beaucracy.

thanks

@Roz, but UK is not an EEE country (Iceland, Liechtenstein, Norway and Switzerland), at least not yet....

roz66

I do know that unfortunately! Which is why Art 15 is necessary. If my husband was an EU citizen we could both get a CRUE. Applying for Art 15 status for him  can occur once I get my CRUE. The point is it is NOT a family reunification process.

I hope that makes sense, at least it does to me!

@JohnnyPT I don't think his wife and kids are EEE.

Nia Queiroz

@roz66 We call it family reunification as well as art 15. The naming and formality is different but the process is very similar and has the same result. Having the family reunite in Portugal.

JohnnyPT

Hi Marius,

Please help us clarify this: What is your wife's nationality? 1f914.svg

Yoyagi

@JohnnyPT Hi there. I have brought confusion about 🙃

I should have been more specific about my non-eu family…they are from Brazil, so this is why I have to apply for a family reunion.

So in my original question i was wondering if it is possible for me to be the fiscal representative when making NIF numbers for my Brazilian wife and son when I get my CRUE?

JohnnyPT

Sure. Any national or non-national can be a tax representative in Portugal, as long as that person is resident in Portugal. Be aware that obtaining your NIF does not make you a resident, only the CRUE. So as soon as you have your residency, you can be their tax representative.

Here is this website from Brazil. Your wife can read it and she will understand everything:
